The National Demolition Association (NDA) released guidance prepared by Auburn Hills, Michigan-based law firm McAlpine PC on March 18 to help demolition contractors prepare for potential disruption of projects due to the COVID-19 virus.
“The COVID-19 outbreak risks disrupting demolition projects in many different ways. Now is the time to prepare your company for addressing delay and disruption impacts to your active jobs from a legal standpoint. ... You should always consult with your lawyer for legal advice relevant to your company’s actual situation, but this guide may help you flag key issues to be aware of and discuss with your attorneys,” NDA wrote in a statement to members.
The report, “Protecting your demolition business in the age of COVID-19,” outlines a number of steps business owners can take to help mitigate ramifications from things like government-imposed restrictions, widespread illness, staffing difficulties and project shutdowns.
Some best practices noted in the report include:
- Giving the project owner/general contractor notice of potential delays
- Tracking impacts of cost overruns and delays relative to COVID-19
- Reviewing the contract’s force majeure clause
- Contacting one’s bonding company and insurance broker
- Discussing the potential for suspension of work with the owner/general contractor
- Taking proactive measures when unable to move forward with a project
